The US Supreme Court on Monday asked President Donald Trump’s administration to do his views about the bid of a bayer to rapidly restrict the cases, claiming that the company’s round -up video causes cancer and potentially disposes of billions of dollars.
Byire has asked the judges to hear the appeal of a lower court’s $ 1.25 million verdict in a trial in the Missouri State Court by St. Louis Jury, in which a plaintiff named John Dornell filed a case after a non -Hudkan’s diagnosis of lymphoma, which led to his round -up.
The Supreme Court asked the Justice Department for his views whether the judges should appeal.
Bill Anderson, CEO of Baire, called the request a “encouraging move”.
“When the courts allow companies to punish under state law to follow federal law, they make companies like us an important target of the legalism industry, and farmers and consumers need their nutrition and health,” Anderson added.
The Missouri Court of Appeal dismissed the German Pharmaceutical and Biotechnology Company’s position that the federal law that ruled pesticides had taken legal action such as claiming a Dornle under state laws. Bayer faces more than 67,000 such litigation in US states and federal courts. Other federal and state appeal courts have made similar decisions.
Round -up is among the most used video clusters in the United States.
Bayer is arguing that consumers should not be able to prosecute under state law if consumers fail to warn that round -up increases the risk of cancer because the US Environmental Protection Agency has not received any such threat and does not need such a warning. Byire argued that the federal law does not allow any warning to be included in the product outside the EPA.
The company appealed the decision in the Dornle case in the Missouri Court of Appeal.
Dornell’s lawyers asked the Supreme Court to remove Baire’s appeal. He said the plaintiff relied on Baire’s advertisement and not only on the label when he chose to use the roundup, and the company’s marketing failed to warn consumers from the dangers of products.
The company has paid about $ 10 billion for most round -ups pending by 2020, but has failed to get a settlement on future issues. Since then, the new litigation has continued. The plaintiffs have said that they developed non -Hudkin’s lymphoma and other cancer forms due to the use of roundups at home or at a job.
Baire, who received roundups as part of the $ 63 billion purchase of the Agrochemical Company Monsovo in 2018, said that decades of studies are safe for roundup and its active ingredients, golfostat, human use.
In the round -up, the company has a mixed record of trial. Bayer has won a series of round -up trials, but in the past few years he has also been subjected to major jury awards, including a $ 2.1 billion decision in a case in the US state of Georgia in March.
Bayer has asked the Supreme Court to consider the round -up legal action before, but was complained in 2022. Since then, a federal appeal court has agreed to separate the company from other appeal courts.
Bayer has threatened to withdraw the round -up from the US market after fighting the legalism. The company has converted Gulfostat into US consumer products with various video cling substances.
