    The Petito family and their legal team are steadfast in their pursuit of justice for Gabby and clarification from the Utah Supreme Court regarding municipal liability and the constitutional right to wrongful death recovery.

    Salt Lake City, Utah – Parker & McConkey, the law firm representing the family of Gabriel “Gabby” Petito, announced that the Utah Supreme Court has scheduled oral argument. Petito v. Moab City Police DeptSupreme Court Case No. 20241368-SC, for March 4, 2026, at 10:00 A.M.

    The case stems from the tragic death of Gabe Petiteau and the resulting legal challenge to the dismissal of the Petiteau family’s wrongful death lawsuit against the Moab City Police Department and some officers. In November 2024, the family’s wrongful death action was dismissed under Utah’s statutory immunity framework, a decision that has been appealed and now presents important constitutional and public policy questions to the state’s highest court.

    The Petito family and their legal team are steadfast in their pursuit of justice for Gabby and clarification from the Utah Supreme Court regarding municipal liability and the constitutional right to wrongful death recovery.

    Judson Burton, an appellate attorney for the Patito family, explained: “The briefing before the Utah Supreme Court emphasized the importance of this case to the future of Utah law. Along with submissions from the Patito family and the City of Moab, numerous AMIs, including local governments and in state use, weighed in collectively. At oral argument, the justices will recognize that the Utah Constitution is one of every citizen’s rights.” It also protects the right to hold government agencies accountable for the wrongful death of a loved one.
